WHY MEDIATION

And Why Most Cases Should Settle

Not every case can settle. But most should — and most will, in the hands of an effective mediator.

Litigation is expensive, unpredictable, and exhausting. Even strong cases carry real risk at trial. The question is rarely whether settlement makes sense — it’s whether the right conditions exist to get there.

That’s where James comes in. Drawing on over 25 years of litigating and trying employment and business cases on both sides of the table, James understands what it takes to move a case toward resolution. Through a combination of pressure, prodding, coaxing, and connection — and an unflinching willingness to share his candid assessment of each side’s strengths and vulnerabilities — James helps parties find the common ground that makes settlement possible.

He doesn’t just facilitate conversation. He drives resolution.

EFFECTIVE. AVAILABLE. REASONABLY PRICED.

James’s mediation practice is built on three commitments that matter to every attorney and client walking into a session:

Effective

James doesn’t just listen — he engages. He prepares as thoroughly as he would for trial, masters the key legal and factual issues in every case, and isn’t afraid to share his candid views when doing so helps break an impasse. His 25-plus years on both sides of employment and business litigation give him credibility with parties and attorneys that mediators without real courtroom experience simply can’t match.

Available

James is accessible and responsive. He works with counsel to find dates that work, and he is committed to giving each matter the attention it deserves — before, during, and after the mediation session. When a session runs long, James stays. When follow-up is needed to bring the matter to a close, James delivers.

Reasonably Priced

Quality mediation shouldn’t be cost-prohibitive. James offers competitive, transparent rates that reflect his commitment to making mediation a genuinely practical option — not another line item weighing on clients who are already bearing the full costs of litigation.

JAMES HARDIN

James Hardin is a seasoned mediator and litigator with over 25 years of experience representing plaintiffs and defendants in employment and business matters throughout California. His extensive career litigating and trying cases as both a plaintiff-side and defense-side attorney gives him a unique ability to understand the very different pressures, perspectives, and interests at play in employment and business disputes — and a deep command of the legal and strategic issues that drive them.

BACKGROUND

Proven & Prolific

After earning his J.D. from UCLA School of Law in 1999, James began his legal career at Paul, Hastings, Janofsky & Walker, gaining foundational experience in employment law. He subsequently practiced at Call, Jensen & Ferrell and Robinson, Calcagnie & Robinson before establishing his own firm, where he litigated employment and business matters for many years.

Throughout his career, James has represented clients across two broad practice areas. On the employment side, his cases have included wrongful termination, discrimination, sexual harassment, retaliation, wage and hour violations, medical and family leave disputes, employee benefits, privacy violations, and class actions. On the business side, he has handled contract and commercial disputes, partnership and shareholder disagreements, trade secret and unfair competition claims, fraud and misrepresentation, business torts, and real estate and property disputes. That breadth of experience — spanning both employment and business litigation, and both sides of the courtroom — informs every mediation he conducts.

A RESULTS-DRIVEN APPROACH TO MEDIATION

James approaches every mediation the way he has always approached litigation: with thorough preparation, a command of the facts and the law, and a clear-eyed focus on what it will take to resolve the case.

He listens carefully to all parties to foster openness and trust. He identifies the real obstacles to settlement — whether legal, practical, or emotional. And when the moment calls for it, he speaks frankly, applying the kind of constructive pressure that breaks deadlocks and drives cases toward resolution.

James mediates employment disputes of all kinds — wrongful termination, harassment, discrimination, retaliation, wage and hour, and more — as well as a wide range of business disputes, including contract claims, partnership and ownership disagreements, and trade secret matters.
